General terms and conditions Islandica

The website: http://www.viajesislandia.com/ (hereby referred to as "Website") is owned and operated by ISLANDICA s.r.o. / CA - Cestovní agentura and CK Cestovní kancelář (hereby referred to as "Islandica" and "ISLANDICA") This website (“Website”) is owned and operated by ISLANDICA s.r.o. (also ISLANDICA and Islandica). Through the use of this Website, the use of our services, or by contacting us through an online form or email, the client expressly accepts full and unreserved adhesion to each and every one of the conditions of service of Islandica at the same time in which they access them. Therefore, we ask all our customers to read these General Terms of Service carefully before using our Website. This document establishes the General Conditions of Use of the services provided through the website www.viajesislandia.com, which reserves the right to modify and periodically update them, without obligation of prior communication to users / clients.

Our Website has been created and maintained in order to offer information, reservations and tourist services in Iceland to all visitors and guests of our Website. Its use is not allowed for other purposes without the express consent of Islandica. Specifically, it is prohibited to: include or use information or photos of our Website on other pages or in any type of publication without our express written consent. The name of ISLANDICA and TRAVEL ICELAND have registered decree of protected trademark. 

1. GENERAL INFORMATION

DOCUMENTS: The personal and family documents of all passengers (including children) must be in order. The client must verify that the passport (and visa, if necessary) or ID are valid before booking or undertaking the trip. In the case of being rejected by some authority or being refused entry for not meeting the requirements that are required, Islandica will not be responsible for the additional expenses or reimburse the contracted services.

DOCUMENTATION AND VOUCHERS: In the case of loss of travel documentation (vouchers, plane tickets, passports, etc.) by our clients that cause loss of contracted services, Islandica will not be responsible for additional expenses for a new reservation and issuance and no money will be refunded.

PRICING / PRICES: All prices indicated on ISLANDICA s.r.o. Website are per person, unless otherwise specified. These prices do include the VAT taxes. All prices quoted on our Website are based on current purchasing prices in Iceland. ISLANDICA s.r.o. reserves the right to increase the prices published on our Website, without notice, in the event of currency fluctuation, changes to government taxes, or due to any other cost increases beyond ISLANDICA s.r.o.'s control. ISLANDICA s.r.o. will cover only the price increase up to the equivalent of 5% of the total price of the services reserved. Any amount that exceeds this 5%, will be charged to the client. However, the client will have an option to cancel the booking if the surcharge exceeds 10% or more of the services reserved. Important notice: Any unforeseen admission fees to nature sites, parking, or other fees are not included in the price.

PAYMENTS: The client is responsible for making the payment for the reserved and confirmed services within the term indicated in the reservation invoice. After its expiration Islandica reserves the right to add a 0.05% daily interest.

ACCOMMODATION: In Iceland on certain dates if it occurs that the accommodation could not be made in the specified hotel/hostel/Bed&Breakfast originally booked, arrangements will be made for a similar category of accommodation to be reserved instead. It is common that hotels and other forms of accommodation are made up of several buildings, each its own stand alone construction. At certain dates and seasons, it can happen that when making a booking, clients will be placed in a building other than the one containing the reception and/or restaurant. This still constitutes a reservation for the same said hotel and does not change the price or quality of the room in question. Important: When making the reservation, the client is fully responsible for the information offered regarding the number of people staying (without omitting the children, regardless of their age) is correct. In some cases there is the possibility of booking extra beds or cots that must be requested by the clients when making the reservation (before making the payment), since they are not included in the published prices. It is noted that the administration of any type of accommodation can legally refuse to admit the entry of undeclared persons, there being no claim for this cause. EXTRA NIGHT: Islandica offers the possibility of booking extra nights through the web in order to obtain the best prices. Once the trip has started, it is necessary to check the availability through Islandica and make the payment.

VOLUNTARY CHANGES BY THE CUSTOMER: In the event that the client, having paid for the services, voluntarily requests any modification of the contracted services (for example: change of hotel, car, dates, extension of the stay, etc.) Prices may vary. In this case, the customer has to pay the corresponding price and the appropriate management costs, as a result of the processing of the new reservation made.

ANTICIPATED RETURNS: In the case of abandonment of the establishment, excursion, rental of transport, etc. before the contracted date, Islandica is not committed to make any refund.

FLIGHTS: Islandica is not responsible for changes, delays or cancellations in flight schedules and conditions established by the airlines and will not be responsible for the additional expenses in the event of these changes. All sales of airline tickets through links, banners and search engines on our pages are not reserved by Islandica, but are direct sales of the airlines or the corresponding companies. Islandica only presents this additional service to help its customers - banners and search engines work in terms of advertising.

LUGGAGE: In case of lost luggage upon arrival at the airport, we ask that the client solve the problem with the same airline that caused the damage. In air transport, in terms of luggage, the conditions established by the transport companies apply. The ticket, in the case of the airlines, links the transport companies and the passenger. In case of suffering any damage, the customer must submit the claim to the transport company. Islandica will not be liable for damages and / or losses caused.

PASSENGER WEIGHT: Some of the tours might apply weight restrictions. For example the helicopter tours have a weight limit of 120 kg / 265 lbs. If the client does not fulfill this weight limit, extra charge will be requested, which is the price corresponding to 1.5 seats. These rules do ensure that all clients have  comfortable and safe experience.

THEFT OR LOSS: Islandica is not responsible for losses that customers may suffer due to any crime that occurs during their trip or stay of destination. Islandica recommends reporting what happened to the corresponding administrative or police authorities.

TRAVEL INSURANCE: ISLANDICA s.r.o. is not and will not be financially responsible for any changes, Travel insurance is not included in the price of the excursions. We recommend to all of our clients to buy travel insurance in their home country. This insurance should cover the costs of possible cancellations on behalf of the client.or additions due to 'force majuere' .

HONEYMOON: In order to fully enjoy the advantages of honeymoon trips in Iceland, the wedding must be held no more than 5 months before the trip and both Islandica and the hotel have the right to request the supporting documents. Some hotels may require a minimum stay for this type of travel.

SPECIAL OFFERS: The offers on our web pages are not cumulative with each other, nor with other offers that appear in other publications.

EXCURSIONS AND TRAVEL ITINERARIES: All itineraries of our Web pages are subject to possible changes due to operational, weather problems or due to force majeure. ISLANDICA s.r.o. is not and will not be financially responsible for any changes, losses or additions due to 'force majuere' .

HOLIDAYS: Each region of Iceland has its own festivals and holidays and it is possible that transport, accommodation, museums, shops, etc. may vary their normal schedules and even remain closed without prior notice. The additional expenses that they may suffer for these or similar causes will be borne by the customer.

VISA/PASSPORT REQUIREMENTS: Iceland is a part of the Schengen territory and its agreements correspond as such. For details on general visa, passport requirements and health information, please enter the official website of Iceland Ministry for Foreign Affairs.

2. CANCELLATION CONDITIONS
 
2.1. CANCELLATION CONDITIONS FOR TRAVEL AND ACCOMMODATION AND CAR PACKAGES WITH IS and ICE CODES

-10% of the price paid for booking packages and trips is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes, money returns.

- In the case of occurring 19 to 10 days before the provision of services: 30% of the price is non-refundable. 
- Less than 9 days before the provision of services: Islandica will charge 100% of the price is non-refundable. In the event that the client / s does not show up, Islandica will charge 100% of the price paid.

Packages and trips with IS codes are operated by ISLANDICA s.r.o. The expenses that could be occur (bank commissions, commissions of credit institutions, mail, etc.) when sending the total or partial refund of the deposit to the client, will always be at the client’s expense. 

2.2. CANCELLATION CONDITIONS FOR CUSTOM TRIPS, TRAVEL AND PACKAGES FOR GROUP RESERVATIONS OF MORE THAN 10 PEOPLE

-10% of the price of any reservation for a group of more than 10 people confirmed by the group and by Islandica is non-refundable. 10% of the reservation price of a customized trip confirmed by the customer and by Islandica is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes and cancellations.

- In the case of occurring 80 to 60 days before the provision of services: 25% of the price is non-refundable. 

- In the case of occurring from 59 to 35 days before the provision of services: 50% of the price is non-refundable (* Groups 100% of the price).

- In the case of occurring from 34 to 26 days before the provision of services: 75% of the price is non-refundable. (* Groups 100% of the price).

- Less than 25 days before the provision of services: Islandica will charge 100% of the price is non-refundable.

Trips with IS codes are operated by ISLANDICA s.r.o. The expenses that could occur (bank commissions, commissions of credit institutions, mail, etc.) when sending the total or partial refund of the deposit to the client, will always be at the client’s expense.

2.3. CANCELLATION CONDITIONS FOR RENTAL CARS, OFF ROAD AND ALL-TERRAIN VEHICLES 
 
Standard rental cars and off-road cars:
- 10% of the price paid for booking packages and trips is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes, money returns.
- more than 5 days before the start of the rental: 10% of the rental price is non-refundable.
- between 4 and 0 days before the start of the rental: 100% of the rental price is non-refundable.

2.4. CANCELLATION CONDITIONS FOR MOTORHOME AND CARAVAN RENTAL
 
 
Motorhome rentals codes:
- 5% of the price for confirmed reservation is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes, money returns.
- more than 40 days before the start of the rental = 5% of the rental price is non-refundable.
- between 39 and 26 days before the start of the rent = 35% of the price of the rental is non-refundable.
- between 25 and 20 days before the start of the rent = 60% of the price of the rental is non-refundable.
- less than 19 days before the rental start = 100% of the price of the rental is non-refundable.
 

2.5. CONDITIONS FOR CANCELLATION FOR RENTAL VANS

- 5% of the price paid for booking packages and trips is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes, money returns.

- more than 20 days before the start of the rent = 5% of the price of the rental is non-refundable.
- between 19 and 5 days before the start of the rent = 20% of the price of the rental is non-refundable.
- between 4-0 days before the start of the rent = 100% of the price of the rental is non-refundable.

2.6. CONDITIONS FOR CANCELLATIONS OF TRANSFERS AND EXCURSIONS OF 1 DAY

- 5% of the price paid for booking excursions and transfers is non-refundable. This percentage represents our cost for booking services and bank charges for processing payments.

- more than one week (7 days) in advance = 5% of the price of the excursion is non-refundable.
- less than 7 days before the scheduled departure = 30% of the price of the tour is non-refundable.
- less than 3 days (72 hours) in advance = 100% of the price of the tour is non-refundable.
 
Please note that the client is always responsible for the bank costs that are 5% of the excursion (of any length) price. These banks costs will be always deducted from the refund. The excursions that have been booked, not cancelled and not attended are non-refundable. In case of any changes to the original booking, ISLANDICA s.r.o. charges a 15 EUR fee. The cancellation date will be the same day in which ISLANDICA receives the cancellation request in writing, taking into account our office hours from Monday to Friday (08:30 - 18:00 GMT). The provider can cancel the excursion due to bad weather and weather conditions or unfavorable conditions in the destination area. In this case, the client has the right to participate in another excursion depending on the availability of places or can request the return of the total money paid. 
 
Exceptions: These conditions do not apply to diving and snorkeling excursions, the snowmobile excursion on the Vatnajökull glacier and the dog sledding excursion in Mývatn, whose initial cancellation costs are 15%. If you decide to cancel the diving/snorkeling excursion or the snowmobile excursion on the Vatnajökull glacier more than one week in advance, you will be reimbursed 85% of the price of the excursion. But if you cancel the tour less than 2 days (48 hours) in advance, 100% of the price of the excursion is non-refundable. If you decide to cancel the dog sledding tour in Mývatn more than 50 days in advance, you will be reimbursed 85% of the price of this tour. If you cancel this excursion less than 50 days in advance, you will be reimbursed 40% of the price of the excursion.
 
2.7. CONDITIONS FOR CANCELLATION FOR HELICOPTER TOURS

-5% of the price paid for the booking of our tours is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes and cancellations.

- between 30 days and 120 hours before the start = 10% of the price of the tour.
- between 120  hours and 48 hours before the start = 60% of the price of the tour.
- Less than 48 hours prior to the provision of services: Islandica will charge 100% of the price.

The expenses that may arise (bank commissions, commissions of credit institutions, mail, etc.) when sending the total or partial refund of the deposit to the client, will always be at the client’s expense. The provider reserves the right to cancel the tour due to weather and security reasons at any time. In this case the customer would receive 100% of the price paid (if the tour is not performed). 

Disclaimer: We would like to advise our customers that natural phenomena in Iceland can not be guaranteed. Already paid and confirmed excursions cannot be canceled free of charge based on a change or visibility of the natural phenomena. The nature is unpredictable and all the tours are subjected the specified standard cancellation fees. The helicopter flights over the volcanic eruption area will take place whether the volcano is currently active or not. A sightseeing flight as such is a service of flying over a given area, and the activity with red flowing lava of a volcano can not be guaranteed, even though the volcano would be in active mode. For the Northern lights / Aurora borealis phenomenon, suppliers of the tours offer the possibility to repeat the excursion for free if the client does not see the northern lights. The same option is offered for whale watching tours. This is option is not possible for helicopter flights due to operational reasons and high costs of the services provided.

 
2.8. CONDITIONS FOR CANCELLATION FOR PRIVATE OR INDIVIDUALIZED EXCURSIONS AND TOURS

The conditions of cancellation for excursions or tours which are private or made to order, will be confirmed previously to the reservation of the excursion. If the excursions have been made specifically to the clients requests, each excursion can have different cancellation policies, which will be made apparent to the client at the time of the reservation.

2.9. CONDITIONS FOR EXCURSIONS AND WEATHER RELATED MATTERS

Islandica does not operate all the excursions offered on our pages but offers the services of the best travel agencies and tour operators in Iceland. We do not charge any extra fees and therefore we cannot be responsible for the actions of external companies, external guides, itinerary changes, delays, possible accidents or damages, deaths or losses or material expenses caused by other tour operators or travel agencies. Islandica warns customers that the general terms of service may vary with each provider. Islandica advises customers to read the service conditions of each provider from whom they have booked the excursions. The customer can find details about the provider in his/her voucher.

Climate and weather conditions: All excursions to Icelandic nature depend largely on the meteorological conditions, weather and orography conditions in each area in general. That is why we reserve the express right to change the itinerary or cancel the excursion with the client’s safety and the greatest enjoyment in mind. Please keep in mind that Iceland is a country with very specific peculiarities and cannot be compared with other countries where the climate is more stable. The weather in Iceland may change suddenly and these rapid changes can also influence conditions at sea, in the interior of the island, or in rivers. Our suppliers' guides are specially trained to work with changing conditions and their number one priority is to make decisions that prioritize the safety of their customers. That is why it is important that visitors be aware of that and always respect the authority of the guide. If the excursion is cancelled due to the weather conditions, the client is entitled to ask for a refund.

2.10. CONDITIONS FOR CANCELLATION OF ENTRANCE TICKETS TO THE BLUE LAGOON

-10% of the price paid for the booking of individual entrances to the Blue Lagoon is non-refundable. This percentage represents the cost to reserve the services and the extra costs to process the changes and cancellations. If the client decides to cancel the entrance ticket or the transportation to and/or from the Blue Lagoons more than a week (7 days) before the date of the entrance, he or she will receive a refund of 90% of the excursion. If the cancellation of the entrance and/or transportation occurs less than a week's before the excursion, the refund will be for 70% of the price of the excursion. If the cancellation occurs less than 4 days (96 hours) before the excursion, no refund will be issued. You need JavaScript enabled to view it. The date of the cancellation will be that on which ISLANDICA received the written solicitation, taking into account that they office hours are Monday through Friday (08:30-18:00 GMT).

2.11. CONDITIONS FOR CANCELLATIONS OF GROUPS

For groups of 10 or more people, special cancellation conditions apply. 15% of the price paid for the reservation of excursions, transfers and tickets is non-refundable. This percentage represents our cost for reserving services and bank costs for processing payments. If the group decides to cancel the excursion, entry or transfer already booked more than two weeks (14 days) in advance, 85% of the price of the excursion will be refunded. If you cancel the reservation between 14 and 8 days before the scheduled departure, 50% of the price of the excursion will be refunded. But if the group cancels the excursion less than 7 days in advance, the money paid will not be refunded. You need JavaScript enabled to view it. The cancellation date will be the one in which ISLANDICA receives the cancellation request in writing, taking into account our office hours from Monday to Friday (08:30 - 18:00 Icelandic time). The provider can cancel the excursion due to bad weather and weather conditions or unfavorable conditions in the destination area. In this case, the client has the right to participate in another excursion depending on the availability of places or can request the return of the total money paid. If the excursions are made to order and are not regular excursions offered on the page, different cancellation conditions may apply and will always be communicated to the group when confirming your reservation.

2.12 CONDITIONS FOR CANCELLATIONS OF EXCURSIONS OF MORE THAN 1 DAY IN LENGTH

If you cancel the reservation of a multi-day excursion (that is, a tour longer than 24-hours) more than 35 days in advance, you will receive a refund of 80% of the excursion price. If the cancellation of the multi-day excursion occurs between 35 days and 7 days before the excursion date, the client will receive 40% of the excursion price. If the cancellation occurs less than 7 days in advance, the customer is not entitled to a refund of the price paid. Please note that the bank charges and the processing of the return of the payment may incur a fee of 2% of the price. This percentage is charged to the customer's account and will be deducted from the refund price.

2.13 REFUNDS: Refunds are processed in accordance with the cancellation policy accepted when booking services through Islandica https://viajesislandia.com/. (not the cancellation conditions of the providers). If the customer is eligible for a refund, the refund will be processed using the same payment method which was used for the original purchase. Refunds must be requested by the client through the mail This email address is being protected from spambots. You need JavaScript enabled to view it. indicating the full name and the reservation number. When cancellations are made by the supplier (for example due to bad weather conditions) the client has the right to participate in another available departure or request a full refund of the amount paid. The customer has to request the refund in the same way as indicated above. Payment returns have a term of 30 days since just the bank processes with returns to credit cards can take up to 14 business days depending on the issuing entity.

3. VEHICLE AND CAR RENTALS IN ICELAND

INSURANCE IN ICELAND: In the event of an accident, the customer must pay the supplier the total repair or the value to replace the vehicle. With CDW insurance, each rental car company in Iceland sets a franchise for the categories of small cars, larger cars, 4x4 cars, and / or motorhomes. Check the conditions before signing the rental agreement. Keep in mind that insurance in Iceland does not cover damage caused by river crossings, gravel damage and damage caused by driving on tracks marked with letter F for vehicles other than 4x4, also including: Kjölur - Highway 35 and Kaldidalur - Highway 550), etc. It is also forbidden to drive off the roads and tracks (off-road driving), in which case the insurance will not cover the damages caused.

ATTENTION: In Iceland the standard insurances DO NOT COVER the damages caused to the tires, headlights, windows and windshields in case of breakage. Damage to the paint caused by the projection of sand and gravel is also not covered. Rental cars in Iceland ARE NOT insured for water damage. If the client decides to cross the rivers, he does so at his own risk and responsibility. The vehicles are also not insured for any damages down to the undercarriage of the vehicle, such as those caused by animals and for serious negligence of the client and / or driver.

The insurance also does not cover damage caused by force majeure, natural disasters (eruptions, earthquakes, avalanches, lava etc.), wars, invasions, strikes, revolutions or similar causes.

Each client will sign the rental agreement (in English) with the corresponding company when picking up the vehicle. We advise you to read these contracts carefully and to be aware of what the insurance in Iceland covers and does not cover insurance before starting the trip. Islandica is not responsible for any material or personal damage occurred during the trip.

IMPORTANT NOTE: All charges, both mandatory and additional, will be paid directly at the destination in the local currency ISK or EUR. We warn our customers that not even SCDW, ASAAP, GP insurances are full coverage insurance. The customer should make sure that he/she understands the rental conditions of the provider and what the insurance includes or does not include in Iceland. Customers are informed that rental agreements in Iceland are signed in English.

The vehicle shown in the photographs on our website may not be exactly the same as you will receive, but we always guarantee a vehicle of the same or similar category, or higher category. In case you do not agree with a possible change, you must indicate it before picking up the vehicle, subsequent claims will not be accepted. If you detect any problem, indicate it directly to the car rental company in Iceland before starting the trip or during the trip to be able to assist you when necessary. Subsequent claims will not be accepted.

IMPORTANT MOTORHOME NOTE: When renting motorhomes in Iceland one must take into account one very important thing: if there are strong winds and storms (which can happen especially during the low season months and September, but also during the high season June -August), it is totally forbidden to drive with the motorhomes. With motor homes (especially with larger ones) it can be very dangerous to drive in certain areas when there are strong winds. Therefore it may happen that the provider calls customers and urges them to wait for a few hours. All this must be taken into account when booking and planning motorhome holidays in Iceland. Compensation is not offered for days when the client cannot drive with the motorhome due to weather conditions.

4. DISCLAIMER OF RESPONSIBILITY 
 

The excursions offered on our pages are activities of other operators and travel agencies. Islandica acts as an intermediary agent with operators and therefore will never take responsibility for damage, loss or accident caused by participation in, or in connection with these activities. We advise our clients that by contracting any of the services through out pages, the customer also accepts the terms of service of our provider(s). These conditions can be consulted in their corresponding web pages or in the respective contracts. Responsibility: All these activities will be carried out under the clients' own responsibility. Clients must behave at all times in accordance with the instructions of the guides. Islandica is not responsible for any accidents that may be caused by the participants during the activities or for their actions.

Islandica assumes no responsibility for accidents that may be caused by supplier errors or that are caused by factors beyond human control (force majeure).

Islandica assumes no responsibility for cancellations caused by factors beyond human control (force majeure). There will be no obligation to compensate them when the cancellation of the contracted services, changes, delays or personal or material damages are due to force majeure, understood as such circumstances such as: earthquakes, volcanic eruptions, wars, floods, strikes, accidents, weather, diseases, etc.

The client must be aware that activities which occur out in nature in Iceland carry an inherent risk because nature is unpredictable. Customers who participate in these excursions accept these conditions and assume their own responsibility. In addition to this, they may have to sign a document about it with the provider before starting the tour.

The descriptions of the excursions on our web page are rewritten from the providers’ pages. We reserve the right to change the information provided or prices if our provider does so. We warn customers that this translation does not have to correspond exactly to the provider’s version.

5. TOUR OPERATORS / COLLABORATING TRAVEL AGENCIES
 

All our collaborating operators or travel agencies reserve the right to change the itinerary when necessary. Should this happen, Islandica is not responsible. Everything specified on our website is informative.

The client undertakes all activities and excursions at his own risk. Islandica does not assume responsibility for possible material or personal damages occurred during trips, activities, transfers or excursions.

Our suppliers reserve the right to be able to change the prices for the services provided if inflation between EUR / ISK changes out of expectations (more than 5%). Islandica reserves the right to adapt prices according to the necessary changes of its suppliers. In this case we would notify the client indicating the change and the client can cancel the reservation without any expenses.

Islandica is an insured licensed travel agency (Cestovní kancelář), but also operates as travel agent "Un Agente de viajes" / / Cestovní Agentura. Some of the packages offered on our website are operated by our partner travel agencies (Icelandic, Spanish or Danish) that meet the requirements established by the country of origin. The sale is in direct collaboration or also through advertising (when the client pays directly to the corresponding travel agency in which this case he must accept the conditions of service and cancellation of the partner travel agency, as it is not an Islandica sale).

6. ISLANDICA s.r.o., TRAVEL AGENCY 

Islandica s.r.o. is a travel agent (CA-Cestovní agentura) and a travel agency (CK-Cestovní kancelář). The surety insurance (endorsement before the administration) can be consulted here. Surety insurance for travel agencies is a mandatory insurance required by the MMR Ministry (Ministerstvo pro místní rozvoj České republiky) competent in this area to guarantee the obligations arising from the activity as a travel agency for the commitments assumed. The regulations governing travel agencies are included in Law 159/199 Sb. of June 30, 1999 and in the corresponding updates of the same ministry.

The data provided by the User will be incorporated into a personal data reservation system, and will only be processed in order to provide the services requested by the User. The User authorizes Islandica to include their personal data in our files, as well as their use and automated or not, treatment for the management of our services. The User authorizes Islandica to transfer their data to companies directly or indirectly linked to Islandica. The personal information collected from registered users is stored in a database owned by Islandica, which assumes the technical, organizational and security measures that guarantee the confidentiality and integrity of the information in accordance with the provisions of the current Law of Czech Republic, Protection of Personal Data, and other applicable legislation. ISLANDICA s.r.o. only shares the necessary information to be able to process the excursion bookings and the payment transactions. 9. RESPONSIBILITY - EXCURSIONS IN ICELAND NATURE

All outdoor activities in the Icelandic nature carry an inherent risk. ISLANDICA s.r.o. or its providers do not assume any responsibility for accidents, loses or injuries that are experienced by or caused by its customers or can be traced to their own actions or are caused by factors outside of human control (Force majeure). Our clients should take note that all activities in the Icelandic nature are undertaken entirely at their own risk. The clients must behave in accordance with the instructions of the guides and also take their proper responsibility for their own safety. By reserving any of the excursion at our website and checking the I Agree box and with the reservation of the selected excursion, the client agrees to these conditions. The client also indicates that he/she understands the implications and accepts responsibility for his/her own risk in the participation of any of our excursions. Also the clients should note, that depending on the chosen trip the client may be requested to sign an additional liability release on location prior to certain excursions. Please note, that not all the excursions displayed on our website are operated by ISLANDICA s.r.o. Some of these tours are operated by Icelandic Travel agencies and other companies registered in the touristic sector in accordance with the Icelandic law for travel businesses. In these cases ISLANDICA s.r.o. only works as an intermediary agent.

10. NATURAL PHENOMENONS IN ICELAND

WHALES IN THEIR NATURAL HABITAT

When booking whale watching excursions in Iceland, the customer has to keep in mind that the Atlantic Ocean is not a ZOO. The supplier nor Islandica can guarantee 100% whale watching. If the client did not see the whales during the booked excursion, he has no right to a refund of the money paid since the excursion has taken place and the event was carried out. In the event that the whales were not seen, the client has the right to repeat the excursion with the same provider for free (always subject to availability of places).

AURORA BOREALIS - NORTHERN LIGHTS

When booking the Northern Lights sighting excursions in Iceland, the customer has to take into account that the visibility of this natural phenomenon is not guaranteed. Neither the supplier nor Islandica can guarantee the sighting of northern lights. The excursion leaves only if the weather conditions are favorable. Guides and experts always assess the weather situation and, depending on the conditions, it is confirmed before 6:00 p.m. whether it is essential to cancel the departure. But even if the excursion goes ahead, the client cannot be 100% guaranteed to see the Northern Lights. In case it is not possible, the provider does not return the money paid (since the expenses have already been incurred) but offers the possibility of making the same excursion on a different date for free and according to availability (offer valid for 2 years from the reservation date of the excursion). The itinerary of the excursion varies every day according to the probability zone of seeing the auroras. Customers are warned that trips booked in super jeep cannot be repeated for free in super jeep, but they can be repeated with the same provider by bus.

11. INFORMATION AND RESERVATION ON OUR PAGES

The use of our website wwww.viajesislandia.com implies full acceptance of the terms of the agreement. If the user / client finds them unacceptable, Islandica requests that the client / user kindly does not use this website. We reserve the right to update and modify this agreement unilaterally and at any time by updating this page of the website. The changes made will be valid from the date of publication. If any part of this agreement or these conditions becomes invalid or non-binding, the other parts will remain valid and will be subject to the rest of the conditions.

13. CLIENT RESPONSIBILITY

The client that manages, reserves and / or pays for the services expressly accepts these conditions of services and, in addition, is obliged to communicate them to the people who will enjoy these services with him.

14. LEGISLATION AND JURISDICTION

The provision of the service is governed by Czech law, with the Prague Courts being competent, to which the user-client expressly submits.

JURISDICTION: Any conflict that arises as a result of the provision of services in Iceland (such as: accidents, damage caused to rental cars, fines, etc.), or the cancellation of services contracted with suppliers, rental companies and Icelandic travel agencies (such as cancellations by force majeure) will be resolved according to Czech laws in correspondence with Icelandic laws. By accessing this Website, the client is agreeing that the Courts of Prague, Czech Republic will resolve any disputes which may arise between ISLANDICA s.r.o. and the client, and that Czech law shall be the applicable law.
